Ensuring Access to Justice: A Completed CLAS Assignment
A 44-year old, who earned his living as a ‘garang guni’ man, was charged and claimed trial to a charge of fraudulent possession of property under s 35(1) of the Miscellaneous Offences (Public Order and Nuisance) Act (Cap 184).
The accused, who was single and never held a regular job in his life, applied for legal aid on 6 April 2006 under the Criminal Legal Aid Scheme and was assigned a CLAS volunteer counsel on 19 April 2006. The case was subsequently fixed for hearing for two days.
The case against the accused was that the accused had two bags of electrical goods in his possession which were reasonably suspected of being fraudulently obtained as he could not satisfactorily account for them.
Mr Brendon Choa, the CLAS volunteer counsel, made representations to the Attorney-General’s Chambers to request for a withdrawal of the charge against the accused but was unsuccessful.
At the trial, the CLAS counsel argued that the prosecution had failed to prove beyond a reasonable doubt that the items were reasonably suspected of being fraudulently obtained.
Following a two-day trial, District Judge Shaiffudin acquitted the accused on the grounds that the prosecution failed to prove beyond a reasonable doubt the elements of the offence.
The accused and family were pleased with the outcome of the case and thanked CLAS for their assistance.
